The following properties located in Northeastern Alberta are being offered for sale by the Personal Representatives for the Estate of Mike Hesson, by soliciting tenders to purchase, subject to the restrictions in the existing certificates of title, namely:
Parcel One: SE 22;64;5;W4 containing 160 acres, more or less, as described in the Certificate of Title Number 222 052 004 +5, located in the Municipal District of Bonnyville No. 87, Alberta. The property has an annual surface lease revenue of $2,100.00. Prospective purchasers are responsible for conducting their own research on the property to confirm acreage, condition, surface lease revenues, and assessments of the land.
Parcel Two: NW 23;64;5;W4 containing 160 acres, more or less, as described in the Certificate of Title Number 222 052 004+4, located in the Municipal District of Bonnyville No. 87, Alberta. Prospective purchasers are responsible for conducting their own research on the property to confirm acreage, condition, surface lease revenues, and assessments of the land.
Parcel Three: SW 23;64;5;W4 containing 160 acres, more or less, as described in the Certificate of Title Number 222 052 004+3, located in the Municipal District of Bonnyville No. 87, Alberta. The property has an annual surface lease revenue of $1,900.00. Prospective purchasers are responsible for conducting their own research on the property to confirm acreage, condition, surface lease revenues, and assessments of the land.
1. Completed tender forms, in the form prepared by Kress Law, must be enclosed in a sealed envelope and received in the offices of Kress Law by the deadline to be considered. To obtain more information or tender forms, contact Kristen Kress directly at 780-826-3355.
2. Completed tenders must clearly indicate the notification address and identity of the bidder. Each tender must be accompanied by a deposit in an amount equal to 5% of the tender amount, payable to Kress Law (in trust), payable by bank draft or certified cheque only.
3. The seller reserves the right to reject any and all bids. Where the highest bid is rejected, the bidder may be provided with an opportunity to pay the estimated fair market value. The deposits of unsuccessful bidders will be returned after the deadline. Successful bidders will be contacted by Kress Law within seven days of the deadline. The deposit of a successful bidder will be forfeited if they do not complete the agreement for purchase. No tenders shall be released to the public.
4. The title shall be conveyed free and clear of any financial encumbrances. All current registrations shall remain except for Mortgage No. 872 183 758 registered on SW 23;64;5;W4.
5. The possession date shall be 12:00 noon on Monday January 16, 2023, and the balance of the tender price shall be paid by that time. The buyer shall be responsible for all of the 2023 property taxes. There shall be no adjustments of surface lease revenues or annual lease income. All GST shall be the responsibility of the buyer.
6. Bidders must understand that a tender is an unconditional offer to purchase the Land and they must rely on their own research of the Lands. Any information provided is for reference only.
7. The Land and all fixtures and improvements are sold “as-is” and no representations or warranties as to the value and condition of the Land are given. The bidder is solely responsible to determine the value and condition of the Land being sold including the land quality, zoning, land use, environmental condition and any other information. Mines and minerals are excluded.
